Jail Time:

0-90 days;

48 Hours Mandatory Jail Time if convicted of Aggravated* 1st DWI;

Mandatory 48 Hours if offender fails to comply with the sentence of the Court.

Criminal License Revocation: **

1 year unless offender is sentenced to and completes DWI school.

Effective June 17, 2005!! Ignition interlock must be installed on all vehicles driven by the offender for at least one year If convicted of DWI.

License fee: $100;

Crime lab fee: $65;

Community fee: $75;

DWI School: up tp 125;

Alcohol screening: $100-$200;

Interlock fee $960 per year or more.

* Aggravation is based on: 1.) B.A.C. of .16 or higher; or 2.) Refusal to provide a breath and/or blood sample; or 3.) Causing bodily injury as a result of DWI.

** Criminal license revocation is separate from Motor Vehicle Department (Administrative) revocation. It is possible to win your criminal case and still be revoked by MVD; likewise you can win your MVD Hearing (See "Requesting a Hearing" and still lose your criminal case.
